Minogue wins patent battle for Kylie name but Jenner lodges appeal

Australian pop star and actress Kylie Minogue has won a patent battle to stop Kylie Jenner trademarking the name Kylie after a case that has dragged on for almost two years. However, it is believed that Jenner has already launched an appeal.

Jenner had said in her application that she wanted to use the name on clothing and beauty products.

Both stars use the single Kylie name. Minogue has since the 1980s has been instantly recognisable under the just the name Kylie and has owned the www.kylie.com domain name for over two decades.

Meanwhile Jenner markets products through her Kylie Cosmetics brand and the Kendall and Kylie fashion brand with her sister Kendall Jenner.

Minogue had sent a letter via her legal representatives to the US Patent and Trademark Office outlining why it should not grant Jenner’s trademark application, according to reports.

The Daily mail said that the letter described Minogue is an “internationally-renowned performing artist, humanitarian, and breast cancer activist known worldwide simply as ‘Kylie’.” But it also described 19-year-old Jenner as “a secondary reality television personality”.

The patent office is believed to have turned down the application last week.
